By accessing www.kangu.org (the “Website”), you are agreeing to be bound by these website Terms and Conditions of Use (the “Agreement”), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the Website. The materials contained in this web site are protected by applicable copyright and trademark law.

Restrictions on Use

“Kangu”, the Kangu logo and other branding are trademarks, service marks or trade dress of Kangu. Kangu owns all proprietary rights in the Website and all content contained therein (the “Content”).

You may view, copy and display the Content for your personal, non-commercial use. You may not alter, modify, publish, distribute, publicly display or sell any Content or other proprietary information, or otherwise copy, transmit or use any Content or other proprietary information without the express, prior written permission of Kangu.

Disclaimer

The materials on the Website are provided "as is". Kangu makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Limitations

Termination

This Agreement will remain in full force and effect while you access or use the Website or participate in the program offered therein (the “Program”). Kangu reserves the right, in its sole discretion to terminate your participation in the Program at any time.

Contribution Discrection

While Kangu will endeavor to honor the wishes of the contributors as evidenced by their contribution towards a specific profile, the contributions are not intended to provide a personal benefit to any specific individual and the organizations sponsoring such profiles have some discretion as to how the contributions are utilized (so long as they further our exempt purpose) and furthermore, Kangu will have the ultimate authority to use such contributions at our discretion for purposes consistent with our exempt purpose.

Governing Law

Any claim relating to the Website shall be governed by the laws of the State of New York without regard to its conflict of law provisions.

This is the Privacy Policy for all websites owned or operated by Kangu, Inc., including, without limitation the www.kangu.org website (the "Website"). We are committed to protecting your privacy and preserving your trust. Please carefully review this Privacy Policy to learn about how we collect, use, and protect any personal information you provide us and your choices for managing your personal information. This Privacy Policy is subject to the Terms of Use found above.

What Types Of Information Do We Collect?

We collect information that may personally identify you (such as your name, address, email address, or other data which can be reasonably linked to such information) only if you choose to share such information with us. For example, when you create an account on Kangu, you may choose to use a third-party single sign on registration tool such as Facebook, or provide a username, email address, and a means to authenticate your account (for example, a password). You can also choose to provide additional information, such as your first, middle and/or last name, a picture of yourself or your physical address, through the creation of a public profile page or by updating your account information. If you contact Kangu Customer Service, we will collect the contact information you provide in order to address your question or comment.

We may also use cookies (a small file containing a string of characters that uniquely identifies your Web browser). We may use cookies to improve the quality of the Website. Most Web browsers are initially set up to accept cookies, but you can reset your Web browser to refuse all cookies or to indicate when a cookie is being sent. However, certain features of the Website may not work if you delete or disable cookies. Certain of our Service Providers (defined below) may use cookies in connection with the services they perform on our behalf.

How Do We Use The Information We Collect?

We will not sell, share, or rent personal information to third parties, and we will not otherwise disclose personal information to third parties, without your permission, except as disclosed in this Privacy Policy.

A basic public profile page will automatically be created for you when you register for an account at Kangu, which shows your Kangu profile url, your username and the date on which you joined. If you have chosen to provide additional information, such as your first, middle and/or last name, a picture of yourself or your city/state/country of residence, Kangu will display this information on your public profile. You may remove it at any time. When you donate to a Mama, your public profile will also show the Mamas you have donated to. Your username and, if you provided one, photo, will also appear on that Mama’s Kangu page. Kangu may also display the general regions where our donors are located.

By establishing an account on Kangu, you agree to receive emails or other written communication, such as physical mail, based on your account status or activity, including confirmations of donations you have made and changes to your account information.

By default, you will receive update emails on your donations that are sent by our field partners through the Website. Our field partners will send such emails through a webform and will not have access to your email address.

By default, you may receive periodic newsletter emails from Kangu. The frequency of these newsletters may vary. You can choose to unsubscribe to these newsletters at any time.

From time to time, we might establish a business relationship with other persons or entities whom we believe trustworthy ("Service Providers"). For example, payment processing for the addition of funds into a Kangu account is provided by PayPal. We provide our Service Providers with the information needed for them to perform these services. Each Service Provider must agree to implement and maintain reasonable security procedures and practices appropriate to the nature of your information in order to protect your personal information from unauthorized access, destruction, use, modification, or disclosure.

Discussion Areas and Other User Generated Content

Our social networks and other user-generated content can be a useful way for you to express your thoughts on Kangu to other online users. You may use interactive features on Kangu to “like” a particular feature or profile, submit a comment through the Facebook comment function located on the Website, or share Kangu features or profiles with third-party social networking websites such as Twitter. If you use such interactive features, that information will be collected and will be publicly displayed on the Kangu website. When you post messages or otherwise use these features, the information that you provide (including personal information) may also be publicly available to, collected by, and used by third parties. We are not responsible for the content of such messages posted by users or such disclosures of personal information.

Links To Third-Party Web Sites

The Site may contain links to Web sites operated and maintained by third parties, over which we have no control. Privacy policies on such linked Web sites may be different from our Privacy Policy. You access such linked Web sites at your own risk. You should always read the privacy policy of a linked Web site before disclosing any personal information on such site.

Children's Privacy Statement

We do not knowingly collect personal information from children under the age of 13. If we become aware that we have inadvertently received personal information from a child under the age of 13, we will delete such information from our records.

Policy Changes

If we decide to change our Privacy Policy, in whole or in part, we will inform you by posting the changed Privacy Policy on the Website. Your continued use of the Website constitutes your agreement to abide by the Privacy Policy as changed and that such Privacy Policy shall apply to your personal data previously collected by the Website.
